No question of rejection says CEO – D Pandian case

The allegation by the Chief Minister M Karunanidhi stating discrepancies in the nomination papers filed by D Pandian came was strongly opposed by the Communist Party of India (CPI).

ancestral property and was bought from D Pandian’s sister on 9-2-2008. It was also proved with the help of Patta book number 744 dated 25-3-2008. Nallakannu also included that 18 items were declared by D Pandian against the 11 items that were mentioned by M Karunanidhi.

The Chief Electoral Officer Naresh Gupta offered a clear explanation that D Pandian’s nomination cannot be cancelled. Mr Gupta said that the Returning Officer (RO) acted as per the rules. He also showed the Handbook for ROs for Lok Sabha Elections 2009 which says, “If the prescribed affidavits have been filed but are found or considered to be defective or containing false information, the nomination should not be rejected on this ground.”

The CEO, however, held that a solution could be sought by filing an election petition after the election is over. With this, the week long suspense of whether D Pandian would contest or not comes to an end.
